Terms of Service

Effective September 2026. Using cremodel.com, with or without a subscription, means you accept these terms. If you do not accept them, do not use the site. These terms include an agreement to resolve disputes by individual arbitration and a waiver of class actions, in section 13, and a limit on our liability in section 8. Please read both.

1. What this is, and what it is not

CREMODEL is a set of screening tools for commercial and residential real estate: a model, calculators, a document reader and a report writer. They are not an appraisal, an audit, a valuation, an underwriting opinion or a substitute for diligence. They round, they assume, and they leave out things that matter at the diligence stage. Every figure is an estimate produced from the assumptions you enter and from what a document reader believed a document said. Garbage in, garbage out applies in full.

Nothing on this site is investment, tax, legal, accounting, appraisal or brokerage advice, and no fiduciary or advisory relationship is created by using it, with or without a paid subscription. We are not a registered investment adviser, a licensed appraiser, a licensed broker, a lender, an accountant or a law firm, and nothing here should be relied upon as the work of one. Verify every number against the leases, the rent roll, the title, the survey and the financial statements before you offer, sign or lend, and consult a qualified attorney, accountant and licensed broker or appraiser on any real transaction.

2. Your subscription, and how it renews

The subscription renews automatically, at the price and on the term (monthly or yearly) shown on the plans page when you subscribe, and it will keep billing on the same day of each period until you cancel it. You can cancel at any time, in seconds, from the subscription link in your account panel, which opens the payment processor’s own portal; or by writing to contact@cremodel.com. Canceling stops all future billing.

The model runs without a subscription. OMAI Scan, the reports and the portal require an account and an active plan. Introductory pricing, where offered, applies for the period stated on the plans page when you subscribe, and the list price applies afterwards. Every new subscription carries a 72-hour money-back guarantee: write to contact@cremodel.com within 72 hours of your first charge and we refund it in full. Beyond that window, cancellation takes effect at the end of the period you have paid for, and there are no refunds for partial months except where the law requires them. Prices may change with notice, and a change applies from your next billing period, not the current one.

When a subscription ends. Access ends with the paid period. Saved deals and any unspent extra reads end with it too, and are not recoverable afterwards. If your deals matter to you, export the report or the workbook before you cancel. This is stated again in the privacy policy, because it is the consequence people most often miss.

3. Payments are handled by a third party

Payments and subscription billing are processed by Stripe, Inc., an independent payment processor. Card numbers, bank details and billing addresses are collected and held by Stripe, not by us: we never see, receive or store a card number, and we could not charge your card outside the subscription you agreed to. What we receive from Stripe is whether a subscription is active, an anonymous customer reference, and the amount of any extra reads you bought. Your use of the payment flow is also subject to Stripe’s own terms and privacy policy, which are published at stripe.com. Refunds, chargebacks and disputes are settled through Stripe.

4. OMAI Scan, and its allowance

Your subscription includes the document reading feature ("OMAI Scan") subject to a fair-use allowance. The allowance that applies to your account, the number of reads left in the current month and the size and price of any extra reads are shown on your account page, and that page is the operative statement of it. Re-running a document you have already read inside the same period does not consume the allowance. Allowances, the size of a purchase of extra reads and prices may change with notice.

Very large documents are processed in part: the reader prioritises the pages that matter to underwriting and does not undertake to read every page of an unusually long document. The reader depends on third-party processing technology whose availability, capability and cost are outside our control, and we may modify, limit, suspend, substitute the underlying technology of, or discontinue the feature at any time. In particular, in the unlikely event that a third-party provider's pricing, availability or terms change in a way that makes the allowance extraordinary to serve, we may temporarily cap the number of reads an account may run in a day or a month, at a level we set and state on the account page, and restore the published allowance when the circumstance passes. The subscription buys access to the service as a whole; no refund or credit is owed for changes to, interruption of, or the withdrawal of any individual feature, beyond the 72-hour guarantee in section 2. Extra reads are not refundable and unspent reads are forfeited if the subscription lapses.

5. Your account, and acceptable use

Keep your sign-in credentials to yourself; you are responsible for everything done under your account. One subscription is for one person, and sharing a login is a breach of these terms. You agree not to: resell, sublicense or provide the service to others as a service of your own; share, scrape, copy or republish the model, its outputs at scale, or the site; reverse engineer, decompile or attempt to extract the underlying rules, prompts or engine; circumvent the paywall, the allowance or any technical limit; run automated requests against the site or the reader; upload malware or anything unlawful; or use the service to break any law, sanction or contract you are bound by. We may suspend or close an account that does any of these, or that abuses the service or another user, with or without notice, and without refund.

6. What you upload, and the right to upload it

You must have the right to upload what you upload. Most offering memoranda and rent rolls are confidential, and many are under a non-disclosure or confidentiality agreement. Whether you may put a particular document through a third-party reader is your decision and your responsibility, not ours.

By uploading, pasting or typing anything into the service you represent and warrant that you own it or have the right and the permission to submit it for processing as described in the privacy policy, and that doing so breaches no agreement, duty of confidence, license, or law that binds you. You keep ownership of your content. You grant us only the narrow, revocable license needed to process it, return the results to you and store what you choose to save, for as long as your account exists.

You will cover us if that turns out to be wrong. To the fullest extent permitted by law, you agree to indemnify, defend and hold harmless CREMODEL, its owner and its operators from and against any claim, demand, proceeding, loss, liability, damage, penalty, cost and expense, including reasonable legal fees, arising out of or related to: your content and your right to submit it; your use of the service or of anything it produced; your breach of these terms or of any law; or any decision, offer, bid, loan, purchase or sale you or anyone else made in reliance on an output of the service.

7. No warranty

The service is provided as-is and as-available, without warranty of any kind, express, implied or statutory, including any warranty of accuracy, completeness, reliability, availability, non-infringement, merchantability, fitness for a particular purpose, or that outputs will be correct or that defects will be corrected. We do not warrant that the service will be uninterrupted, timely, secure or error-free, and we commit to no uptime, response time or processing time. Any figure a document reader extracts may be wrong: it is a machine reading a document, and it will sometimes misread one. Some jurisdictions do not allow the exclusion of implied warranties, in which case the exclusions above apply only to the extent permitted.

8. The limit of our liability

To the fullest extent permitted by law, CREMODEL and its owner, operators, contractors and suppliers are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss or damage, nor for lost profits, lost revenue, lost opportunity, lost deals, cost of substitute services, business interruption, loss of goodwill, or loss or corruption of data, arising out of or related to the service, the tools, the reports, a misreading, a calculation error, downtime or data loss, however caused and on any theory of liability, whether or not we were advised such loss was possible.

Where liability cannot be excluded, our total aggregate liability for all claims arising out of or relating to the service is limited to the greater of one hundred United States dollars or the subscription fees you actually paid us in the three months immediately before the event giving rise to the claim. These limits apply even if a remedy fails of its essential purpose, and they survive termination.

Your acknowledgment. By creating an account you acknowledge and agree that every output may be wrong, incomplete or inaccurate; that you assume the risk of errors and inaccuracies; that you will independently verify anything you act on; and, to the fullest extent permitted by law, you release, waive and covenant not to sue CREMODEL, its owner and its operators over wrong numbers, misread documents, calculation errors, inaccuracies or omissions, or over any decision, offer, bid, loan, purchase, sale or loss made in reliance on the tools or the reports. This acknowledgment is a condition of the account and survives cancellation.

9. Time limit on claims

Any claim arising out of or related to the service must be brought within one year after the claim arose. A claim brought after that is permanently barred, except where a shorter or longer period is required by law.

10. Intellectual property

The site, the model, the engine, the rules inside it and the report formats belong to CREMODEL and are protected by copyright and other rights. Nothing in these terms transfers any of it to you. Your deal data belongs to you. Reports you generate are yours to use in your own business, on your own letterhead.

Stripe is a trademark of Stripe, Inc. Any other name or mark on this site belongs to its owner and is used only to describe what a thing is.

11. Changes to the service, and to these terms

We may change, add to, limit or withdraw any part of the service at any time, and we may stop offering it altogether, in which case we will refund any unused portion of a period already paid for. We may update these terms; the current version lives at this address, is dated at the top, and continued use after a change means you accept it. If a change is material we will make it visible in the product rather than only here.

12. Suspension and termination

You may stop at any time by canceling. We may suspend or terminate an account for breach of these terms, for non-payment, for abuse of the service, or where we are required to by law. On termination the license to use the service ends immediately, and sections 6 through 9 and 13 survive.

13. Disputes: individual arbitration, and no class actions

Read this section. It changes how a dispute between us is resolved, and it gives up the right to a jury and to a class action. You can opt out of it within 30 days and still use the service.

Before anything formal, write to contact@cremodel.com with the problem and what you want done, and give us 30 days to sort it out. Most things end here.

If that does not resolve it, you and CREMODEL agree that any dispute, claim or controversy arising out of or relating to the service or these terms will be resolved by binding individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, and that the Federal Arbitration Act governs this section. The arbitration will be conducted by a single arbitrator, in writing or by video unless the arbitrator orders otherwise, and judgment on the award may be entered in any court of competent jurisdiction.

Individually, not as a class. You and CREMODEL each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding. You and CREMODEL each waive any right to a trial by jury. If the class action waiver in this paragraph is found unenforceable as to a claim, that claim, and only that claim, is severed from arbitration and heard in court.

What is carved out. Either of us may bring a claim in small claims court if it qualifies, and either of us may seek an injunction in court to protect intellectual property or stop unauthorised access.

How to opt out. Write to contact@cremodel.com with the subject line "Arbitration opt-out", from the address on your account, within 30 days of first accepting these terms. Say that you opt out and give your account address. That is all it takes; opting out costs you nothing and changes nothing else about your account.

14. Governing law, and where a court claim goes

These terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules and without displacing any mandatory consumer protection of the place you live. For anything not sent to arbitration under section 13, you and CREMODEL agree to the exclusive jurisdiction of the state and federal courts sitting in Delaware, and each of us waives any objection to that venue.

15. The rest

Force majeure. Neither of us is liable for a failure caused by something outside reasonable control, including outages at a hosting, payment or processing provider, network failures, natural events, war, or acts of government. Severability. If any provision is held unenforceable, it is limited or removed to the minimum extent necessary and the rest stands. No waiver. Not enforcing a provision once does not waive it. Assignment. You may not assign these terms; we may assign them to a successor of the business. Entire agreement. These terms and the privacy policy are the whole agreement between us about the service and replace anything said before. Notices. We may reach you at the address on your account; reach us at contact@cremodel.com. Age. The service is not offered to anyone under 18, and by creating an account you confirm you are 18 or older and able to enter into a contract. Export. You may not use the service where United States sanctions or export law forbids it. © 2026 CREMODEL.
